El Grupo Internacional recomienda que el Acuerdo Inter-Club 2011 (2011 Inter-Club Agreement) debería aplicarse en todos los contratos de fletamento NYPE/Asbatime. Por tanto el Grupo ha redactado una cláusula de fletamento para promover el uso e incorporación del Acuerdo 2011 en todos los contratos de fletamento NYPE/Asbatime.

BORRADOR DE CLÁUSULA DE FLETAMENTO PARA FOMENTAR EL USO DEL ACUERDO INTER-CLUB NEW YORK PRODUCE EXCHANGE 1996 (en su versión modificada de Septiembre 2011)
El Acuerdo Inter-Club New York Produce Exchange 1996 (en su versión modificada de Septiembre 2011) (“el Acuerdo 2011”) ofrece un mecanismo mediante el cual la responsabilidad por reclamaciones de carga en virtud del modelo del New York Produce Exchange (New York Produce Exchange Form – NYPE) o contratos de fletamento Asbatime y/o contratos de transporte autorizados por dichos contratos de fletamento puedan ser rápida y equitativamente prorrateadas entre los armadores y los fletadores.
El Grupo Internacional recomienda que el Acuerdo 2011 se aplique a todos los contratos de fletamento NYPE/Asbatime y a todas las reclamaciones que se produzcan bajo dichos contratos de fletamento cuando se incluyan y aunque no incorporen el Acuerdo 2011 o cualquier otra versión del Acuerdo Inter-Club New York Produce Exchange.
Con el fin de promover aún más el uso y la incorporación del Acuerdo 2011 en todos los contratos de fletamento NYPE/Asbatime, el Grupo ha redactado una cláusula de fletamento que dispone lo siguiente:
“Reclamaciones de carga
Las reclamaciones de carga entre Armadores y Fletadores deberán resolverse de acuerdo con el Acuerdo Inter-Club New York Produce Exchange 1996 (modificado en 2011), o con cualquier modificación o sustitución posterior. Dicha cláusula tendrá preferencia ante cualquier otra cláusula o cláusulas en este contrato de fletamento procurando incorporar cualquier otra versión del Acuerdo Inter-Club New York Produce Exchange en este contrato de fletamento”.
El contrato de fletamento NYPE 2015 incluye una cláusula similar, la cual también promueve el empleo y el uso del Acuerdo 2011 y es aceptado de igual manera.
Todos los Clubes en el Grupo Internacional han publicado una circular similar.

The International Group recommends that the 2011 Inter-Club Agreement should be applied to all NYPE/Asbatime charterparties. The Group has therefore drafted a charterparty clause to promote the application and incorporation of the 2011 Agreement into all NYPE/Asbatime charterparties.

Draft charterparty clause promoting the use of the Inter-Club New York Produce Exchange Agreement 1996 (as amended September 2011)
The Inter-Club NewYork Produce Exchange Agreement 1996 (as amended September 2011) (“the 2011 Agreement”) provides a mechanism whereby liability for cargo claims arising under the NewYork Produce Exchange Form (NYPE) or Asbatime charterparties and/or contracts of carriage authorised under such
charterparties can be swiftly and fairly apportioned between owners and charterers.
The International Group recommends that the 2011 Agreement should be applied to all NYPE/Asbatime charterparties and claims arising under such charterparties whenever entered into and whether or not they incorporate the 2011Agreement or any other version of the Inter-Club NewYork Produce ExchangeAgreement.
In order to further promote the application and incorporation of the 2011 Agreement into all NYPE/Asbatime charterparties, the Group has drafted a charterparty clause which provides as follows:
“Cargo claims
Cargo claims as between Owners and the Charterers shall be settled in accordance with the Inter-Club NewYork Produce Exchange Agreement 1996 (as amended 2011), or any subsequent modification or replacement thereof. This clause shall take precedence over any other clause or clauses in this charterparty purporting to incorporate any other version of the Inter-Club NewYork Produce Exchange Agreement into this charterparty”.
The NYPE 2015 charterparty contains a similar clause,which also promotes application and use of the 2011 Agreement and is equally acceptable.
All Clubs have issued a similar circular.
